Fair Use

Basic Simple Guidelines

  • Provide students with the smallest proportion of copyrighted materials that will fill the educational need (if a 10 page excerpt will do, provide that rather than copy the entire chapter)
  • Take advantage of library e-reserves and electronic linking so that students can access materials on their own
  • Use original materials in their original formats as much as possible (circulate or have students take turns with novels or DVD's rather than distribute copies)
  • One-time spontaneous educational use with no profit impact to the copyright holder is almost always fair use
  • Repeated and planned use (of more than 10 % of a protected work, or of the critical portion of a protected work) generally requires permission of the copyright holder
